We, at BuildNext, aim to adhere to ethical standards pertaining to collection, usage and safeguarding of the information provided by You during the use of the Application and the Website. BuildNext Construction Solutions Private Limited is a private limited company incorporated under the Companies Act, 2013 having its corporate office at 67/2355, V-One Plaza, Second Floor, Old Railway Station Road, Near Income Tax Office, Ernakulam, Kerala - 682018, India ("Company", "We", “Our”, "BuildNext”, “Us”).


The Company owns, operates and manages the website https://descon.ai/(“Website”), including an optimized version of the Website designed for access via mobile phones, smart devices and other compatible devices (hereinafter referred to as “WebApp Version”) under this brand “Descon.ai” (the Website and the WebApp Version shall be collectively referred to as the “Platform”) whereby We, through the Platform, provide project management solutions for architects by streamlining workflows, enhancing efficiency, and offering analytical dashboards with tracking and reporting tools to monitor budgets, timelines and overall project performances (“Services”). This Privacy Policy (“Policy”) applies to the Services extended by the Company through the Platform. ‘You’ or ‘Your’ or ‘Yourself’ or ‘User/s’ shall include any natural or legal persons who are availing the Services offered by the Company and in the event that a natural person is representing a business entity, reference to such terms shall include a reference to such business entity as well, accessing the Platform merely as visitors or undertaking any of the Services provided by BuildNext across all levels, in addition to all the employees (permanent or contractual) or contractors, associates, and vendors.


We have adopted this Policy to inform You of: (i) the information We collect from You through the Platform; (ii) the manner of collection and processing of such information; (iii) use of such information; and (iv) the steps We take to protect it. Please read the Policy before using the Services. By accessing Our Platform or using any of Our Services or products, You acknowledge and agree to all the terms of this Policy. In doing so, You provide Your explicit and unconditional consent, in accordance with Sections 43A and 72A of the Indian Information Technology Act, 2000, for the collection, use, storage, processing, sharing, transfer, and disclosure of Your information by the Company. Your usage of the Services and/or the registration with us via any mode or Device shall signify Your acceptance of this Policy and You agree to be legally bound by the terms and conditions mentioned therein. You acknowledge that You have the full legal right and lawful authority to disclose the information shared with us. Furthermore, You confirm that the collection, sharing, processing, and transfer of such information shall not cause any loss or wrongful gain to You or any other person. If You do not agree with the terms of this Policy, kindly do not register or use the Platform or avail any of Our Services. Please note that the capitalized terms not defined under this Privacy Policy shall have the same meaning as assigned to such terms in the Terms and Conditions. For legal purposes, this Policy is the notice required under the Digital Personal Data Protection Act, 2023 (“DPDP Act”).

1. USER INFORMATION

The Platform collects certain information and data when You register via the Website or the Webapp, subscribe to Our communications, interact with Our customer support, or otherwise transact with us. It also covers data processed on Our behalf by third-party service providers (payment processors, delivery partners, analytics providers, marketplaces, etc.). Where relevant, We distinguish between “Data Principal” (You) and “Data Fiduciary” (BuildNext) as used in the DPDP Act. There are two types of information being collected: (i) User Information; (ii) automatically collected information (“Auto-Collected Info”) during the usage of the Service(s).

(a) User Provided Information and Access

(i) We collect Your information when You use the Platform, request for a demo, access or avail any Services on Our Platform, either as a registered user or a visitor. During this process we may collect Your email address, name, phone number, address, IP-based geographical location, bank details, transaction related information while availing any offers and other personal details. We may also collect information to enable us to check and verify Your identity, unique identifiers, such as username or password, details entered to and stored in the account of the User on the Platform, information provided to us through Our Service, interaction with Our customer service and third party providers, participation in surveys or marketing promotions. We may also ask You to share the OTP sent via SMS or a password or to verify a link sent on Your e-mail address. We also keep records of telephone calls received and made for the purpose of inquiries, orders, or other purposes necessary for the rendering of Services. All this is necessary to uniquely identify and authenticate You. With Your permission we may also collect information about Your location, age, and contact list. Further, We may also collect information about the computer, mobile, laptop, tablet or any other internet enabled electronic device (“Device”) that You have used to access the Services.

(ii) When You submit User Information on the Platform, it shall be deemed that You have granted Us the right to collect, store, process, handle and use such User Information, in accordance with this Privacy Policy (as amended from time to time). Further, You agree and consent to receive all communications related to Our services on the mobile number provided by you to the Company, even if such mobile number is registered under DND/NCPR list under the Telecom Commercial Communications Customer Preference Regulations, 2018 (“TRAI Regulations”).

(iii) We may ask for permission to access Your data storage. However, the data storage access shall be limited to the access to store the data downloaded or saved during the usage of the Platform directly in the User’s device for ensuring easy storage and access to the User. We shall not utilize this permission to access any other data on the User’s device, except as expressly mentioned in this Privacy Policy.

(iv) While You are using Our Services on the Platform, we record Your responses and activity data, including but not limited to, textual and voice responses recorded while interaction with Our customer care and third party providers.

(v) While using/ accessing the Platform, We may ask permission to access the location of Your Device for providing better Services. We shall not utilize this permission to access any other data on the User’s Device, except as expressly mentioned in this Policy.

(vi) The said information collected from the Users could be categorized as “Personal Information”, “Sensitive Personal Information” or other information and would be governed in accordance with the DPDP Act, together with any rules, notifications, or directions issued thereunder. To the extent applicable, Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (the “IT Rules”), Consumer Protection (E-Commerce) Rules, 2020 or Information Technology (Intermediary Guidelines & Digital Media Ethics Code) Rules, 2021 and other relevant applicable laws of the jurisdiction may also apply and for the purposes of this Policy, all such information shall collectively be referred to as “User Information” in this Policy.

(vii) We may use the User Information to contact You from time to time, to provide You with the Services, important information and circulate marketing and promotional material. We may ask You for more information for identification purposes, if required. We shall intimate about the User Information provided by You to the Third Party Providers for the purpose of providing the Services. The User shall be permitted to access the Platform via any Device provided that the log in/access credentials match with the User credentials. In the event the User uses a new Device to access or log-in to the Platform, the User shall be required to grant access for the new Device, as may be required.

(viii) You may visit the Platform and browse the Platform without having to provide User Information. We will, at all times, provide the option to You to not provide the Personal Information or Sensitive Personal Information, which We seek from You. Where possible, We indicate which fields are mandatory and which fields are optional to be filled on the Platform. You always have the option to not provide information by choosing not to submit particular information or feature on the Platform. In such event, however, the Company fully reserves the right not to allow further usage of the Platform or provide any Services/products thereunder to You.

(ix) By using this Platform, You consent to the collection, storage, use and transfer of the User Information that You provide in connection with any of the Services that We offer through Our Platform, and You consent to Our collection of any changes or updates that you may provide to the User Information. We collect only such User Information that We believe to be relevant for the purpose of identification and verification and is required to understand You or Your interests. It is clarified that We shall not be liable, for any reason whatsoever, for the authenticity of any User Information provided by You to Us. You hereby confirm that the User Information provided by You is and shall continue to be valid, true and accurate to the best of Your knowledge.

(x) We will, at all times, provide the option to You to not provide the Personal Information or Sensitive Personal Information, which we seek from You. In such an event, however, the Company fully reserves the right to not allow further usage of the Platform or provide any Services thereunder to You.

(xi) Although Our Platform may be accessed by children, Our Platform is intended only for use by individuals above eighteen (18) years. We collect personal data relating to children only through their parents or legal guardians and only to the extent necessary to deliver Our products.

(xii) Any portion of the User Information containing personal data relating to minors or a person of unsound mind provided by You shall be deemed to be given with the consent of the parents/legal guardian as required under the DPDP Act. By providing such information, You represent and warrant that verifiable consent has been obtained from the parent or lawful guardian. Such consent is deemed to be provided by Your registration with us.

(xiii) Your personal data may be stored or processed on servers located outside India (for example, by Our cloud hosting or analytics partners). In such cases, We ensure that transfers are made in compliance with applicable laws, including the DPDP Act.


(b) Automatically Collected Information

We may collect and store certain information automatically when You login to the Website use the Webapp Versions, including but not limited to, the IP address, Your Device ID and Device type (in case of the Application).

A. Data You provide directly:

(i) Account registration: name, date of birth, email address, password (securely stored), phone number;

(ii) Payments: We do not collect full card details on Our servers - payment details are processed by third-party payment processors (“PSPs”) such as Razorpay and Chargebee; we may store payment tokens or transaction IDs returned by PSP;

(iii) Customer support: chat transcripts, emails, call recordings (where consented/stated);

(iv) Marketing preferences and opt-ins (email / SMS / WhatsApp opt-ins);

(v) Reviews & feedback: any content You post publicly (product review, photos).

B. Data collected automatically

(i) Technical data: IP address, browser type and version, device type, operating system, device identifiers, crash logs, and language settings.

(ii) Usage data: pages visited, timestamps, referral URLs, session duration, items viewed, cart behaviour.

(iii) Cookies & tracking identifiers (see Section C]). these power targeted advertising (retargeting) on platforms such as search engines and social media.

This type of information does not identify You personally during Your visit to the Platform. We can identify You only after You submit User Information at the time of registering Yourself with the Platform.

C. Data from third parties

(i) Social login or advertising networks: if You use social login or click on ads, partners may share identifiers or profile data.


2. COOKIES

Like most other platforms, We use data collection technologies such as cookies, local storage, pixels, data collection devices and similar tools to collect and store information about Users of the Platform.  A cookie stores small bit of information stored by Your browser and tracks Your preferences which can be utilized in order to provide customised Services. This data is used to improve the Services and offerings, such as providing more content in areas of interest to a majority of Users. However, You can disable cookies and reset the browser whenever You want through Your browser settings. Although, some of the features or Services may not function in a proper manner if the cookies are disabled and We may not be able to provide certain personalised Services and a better learning experience. We use these technologies for purposes including:

(i)       Operating the Platform and enabling core features (e.g., checkout, saved carts).

(ii)     Remembering Your preferences and enhancing User experience.

(iii)    Measuring and improving Platform performance, running A/B tests, and analysing traffic.

(iv)    Securing transactions and preventing fraud.

(v)     Delivering interest-based advertising and marketing campaigns, including retargeting across Google, Meta, and other third-party platforms.

The data collected through cookies will be anonymous or pseudonymized, and We maintain such data distinctly from User Information that You submit directly to Us.

(ii) To register You on the Platform, performing technical administration, auditing, data analysis, and customization to enhance the Platform’s functionality, security, and User experience.

(iii) To inform You about various Services offered on Our Platform and provide customer support to You.

(iv) To address Your queries and resolve Your concerns pertaining to any service that You were looking for.

(v) To complete payments, process refunds, reconcile transactions, and detect and prevent fraud. (Processed via PSPs; We may share transaction details with banks/PSPs.)

(vi) To send You a survey and facilitate various programmes and initiatives launched either by us or third party which We believe may be of interest to You.

(vii) To review Platform performance, diagnose technical problems and conduct data analysis to make Your experience better.

(viii) To analyse and draw trends from the aggregated statistics of the User activity.

(ix) To provide personalised recommendations and offers maintain general and personalized content, to send transactional messages (order confirmations, delivery updates) and, if You opt in, promotional emails/SMS/WhatsApp and personalised ads using permitted identifiers and advertising platforms. WhatsApp promotional or template messages follow WhatsApp Business guidelines (templates and opt-in requirements) and We keep records of opt-ins and SMS follows TRAI guidelines, as required.

(x) Identification and authentication of Your use of Services.

(xi) To facilitate Your usage of the Platform (i.e. the kind of features You like, Your searches and results, etc.) and improve Our features and provide seamless service based on the information and feedback received from the User.

(xii) To track transactions and process payments.

(xiii) To conduct research, surveys, analysis, and improvement/development for the business of the Company to administer the Services on the Platform.

(xiv) To undertake promotional activities and/or contests.

(xv) To send You relevant notifications through e-mails and SMS which add to the effectiveness of the Service.

(xvi) To respond to any queries/doubts raised by You and resolve Your concerns pertaining to the Service.

(xvii) To operate call/chat support and to keep records of interactions (chat logs, call recordings where local law requires notice/consent).

(xviii) To inform You about change in any term and condition of this Policy or terms of use of the Platform of BuildNext.

(xix) To analyse Website usage, run A/B tests, and improve product assortment and the shopping experience (via analytics providers and aggregated, anonymized metrics).

(xx) To comply with tax, audit and other statutory obligations (e.g., retention for accounting), to respond to lawful requests from authorities, and to protect Our rights and customers against abuse/fraud.

(xxi) To manage Our business, including accounting, risk management, and potential sale or restructuring (in such event We may transfer data consistent with this Policy and applicable law).

(xxii) To implement information security measures, detect security breaches, malware, or computer viruses, and investigate, prevent, or take appropriate action against illegal activities and suspected fraud.

(xxiii) To disclose information to comply with legal requirements, court summons and orders, or law enforcement requests, and sharing data with authorized third parties for lawful purposes.

(xxiv) To send periodic emails for sharing information and updates pertaining to Your order, occasional company news, events, updates, related product or service information, etc.

(b) The User Information is being collected by the Company and the Company will delete any User Information upon the User withdrawing the consent in writing, however, upon the withdrawal of the consent by the User, the Company may, at its option, not provide any Services for which the User Information was sought and the User shall not claim deficiency of services on the basis of such non provision of goods and Services.

(c) To enhance Your use of the Platform, certain information may be collected each time You visit the Platform which are saved in server logs. It is clarified that these statistics help Us in improving the efficiency of the Platform by giving Us User information relating to Your use of the Platform. Such information may include details of the server from where the Platform is being accessed, the browser and operating system used to browse the Platform, details of Your last visit to the Platform, including time, date and the duration of Your session on the Platform. This information is used by us to understand the number of users visiting the Platform and gather broad demographic information for aggregate use of the Platform. While collecting such information, Your anonymity shall be maintained at all times and at no time can We identity You personally, unless You submit the User Information on the Platform or through the e-mail feature. We reserve the right to share such general information to any person on its discretion.

(d) You acknowledge that apart from Your User Information, if You upload, input, or otherwise provide or exchange any data, content, files, information, pictorial representations (collectively referred to as the “Content”) on or through the Platform, including as prompts, training inputs, or materials for processing by the Platform’s AI models, such Content may be processed by the Platform for the purpose of generating outputs and improving the quality of services rendered to You. We do not make such Content publicly available or accessible to any third-party users, except (i) where required for the functioning of the Platform (for example, to securely transmit data through integrated third-party service providers or APIs), or (ii) where disclosure is required under Applicable Law. The Service Provider implements appropriate technical and organizational measures to safeguard the confidentiality and integrity of such Content in accordance with this Privacy Policy and the Terms of Use. For clarity, Your Content is not used to train or fine-tune the Platform’s AI models in a manner that makes such data accessible to or retrievable by other users, unless such data has been aggregated and anonymized in accordance with industry standards.

(e) We may disclose information to:

(i) The employees or contractors or affiliated organizations on a need-to-know basis in order to undertake process on the behalf of the Company or to facilitate smooth functioning of Our Services, such as providing network services, IT support, and customer service.

(ii) Third party ad servers, ad agencies, technology vendors and research firms to serve non-targeted advertisements to the User.

(iii) Prospective investors, strategic partners, sponsors, and others to help growth of the Company's business.

(iv) Any parent company, investor, subsidiary or acquirer in the event of Corporate sale, merger, reorganization, sale of assets, dissolution, or bankruptcy.

(v) Third party service providers in order to personalize the Platform for a better User experience and to perform behavioural analysis.

(vi) Any legal, governmental or regulatory authority if it is required to comply with any legal order or process, issued or commenced, in accordance with the applicable laws.

(f) The User Information shall be disclosed to trusted third-party service providers as it is necessary for them to perform services such as:

(i) Processing credit card payments;

(ii) Serving advertisements;

(iii) Conducting contests or surveys;

(iv) Performing analysis of Our Services and customers demographics;

(v) Communicating with You, such as by way email or survey delivery;

(vi) Customer relationship management;

(vii) Security, risk management and compliance;

(viii) Recruiting support and related services.

(g) In view of the same, You may be subject to the practices of such third parties as well.

(h) Except as provided under this Privacy Policy, We shall disclose the User Information only under the circumstances where the User has provided express instructions or consent towards such disclosure.

We do not make such Content publicly available or accessible to any third-party users, except (i) where required for the functioning of the Platform (for example, to securely transmit data through integrated third-party service providers or APIs), or (ii) where disclosure is required under Applicable Law.
